Compliance in direct selling: how software prevents mistakes

Direct selling is one of the most regulated ways to sell. Consumers have special withdrawal rights, compensation plans must not turn into pyramid schemes, marketing claims must be fair, and every country in the EU adds its own rules. For a company with hundreds or thousands of independent partners, the real risk is not bad intent. It is small mistakes repeated many times: a missing withdrawal notice, an unapproved income claim in a partner's post, a commission paid on an order that is later cancelled.

Good software cannot replace legal advice, but it can make the right process the default and document every step. Here is how Direktvertrieb Solution supports compliance in the areas that matter most.

1. Withdrawal rights, handled per country

Under EU consumer law, customers can usually withdraw from a distance or off-premises contract within 14 days. Member states may extend this to up to 30 days in certain cases, for example after unsolicited home visits. Since June 2026, online traders in the EU must also offer an easy withdrawal function (often called the withdrawal button).

Direktvertrieb Solution covers this in four steps:

  • Country-specific periods: withdrawal periods from 14 to 30 days are stored per country and applied to each order automatically.
  • Automatic withdrawal notice and form: every customer receives the withdrawal information and the model form automatically, without the partner having to remember it.
  • Withdrawal button: customers can withdraw online with a clear button.
  • Commission hold until the period ends: commissions on an order are released only after the withdrawal period has expired. No clawbacks, no corrections in the next commission run, no frustrated partners.

2. Protection against pyramid schemes

The line between legitimate network marketing and a prohibited pyramid scheme is clear in principle: in a legitimate business, income comes from selling products to real customers, not from recruiting. EU law lists pyramid promotional schemes among the commercial practices that are always unfair. The software helps companies stay on the right side of that line:

  • Sales-based compensation plans: commissions are calculated from product sales, not from sign-up fees. See our commission engine.
  • End-customer vs. own purchases: reports show how much of each partner's volume comes from real end customers and how much from their own purchases, so unhealthy patterns become visible early.
  • Buy-back process: a documented process for buying back unsold goods from partners who leave.
  • Inventory limits: limits on how much stock a partner can buy prevent "inventory loading", where partners buy more than they can sell just to qualify.

3. Fair business practices

Many complaints in direct selling start with a single exaggerated claim: a promised income or a product promise the company never made. Direktvertrieb Solution provides approved marketing materials that partners can use and share, and income disclosures that put earnings into a realistic context. Partners get content that is ready to use, and the company keeps control over what is said in its name.

4. Influencer marketing

Many partners now sell through Instagram, TikTok and other channels, which makes them influencers in the eyes of regulators. The software supports:

  • Advertising labels: posts created or shared through the system carry a clear advertising label.
  • Approval of partner posts: the company can review and approve posts before they are published.
  • Protection of minors: rules that keep content and offers away from minors.

This area is moving quickly at EU level. The influencer features will be adapted to the new EU requirements that are expected in this field.

5. Self-employment and the Platform Work Directive

Independent partners must stay independent. If software dictates working hours or ranks partners through opaque algorithms, the relationship can start to look like employment. The EU Platform Work Directive, which member states must transpose by December 2026, also sets rules for automated decisions on digital platforms. Direktvertrieb Solution is designed accordingly:

  • No forced working hours: partners decide when and how much they work.
  • Transparent rankings with human review: rankings and qualifications are explained, and decisions can be reviewed by a person.
  • Documentation of partner status: the independent status of each partner is documented.

Partners see their own figures, rankings and qualifications in the partner portal.

In development

  • Telephone prospecting: opt-in and opt-out rules differ between EU countries. We are building country-specific rules with verifiable, documented consent before a call is made.
  • Home visits: country-specific rules for home visits, including recording prior consent from the customer.

Why build compliance into the software?

Training and guidelines are important, but they rely on every partner remembering every rule in every country. When the rules are built into the system, the correct process happens automatically: the notice is sent, the commission waits, the post is labelled, the consent is recorded. That protects customers, protects partners and protects the reputation of the company and the whole industry.

Note: this article describes software features and is not legal advice. Which rules apply to your business depends on your countries and your sales model; please check them with your legal advisers.

Frequently asked questions

Does compliance software replace legal advice?

No. The software applies your rules consistently and documents what happened. Which rules apply to your company should be checked with your legal advisers.

Can the withdrawal period differ by country?

Yes. The standard EU period is 14 days, but countries may set longer periods for certain sales situations, such as unsolicited home visits. The software stores the period per country.

Why hold back commissions until the withdrawal period ends?

If a customer withdraws, the commission on that order would otherwise have to be clawed back from the partner. Paying it only after the period ends avoids corrections and disputes.

Which features are still in development?

Country-specific rules for telephone prospecting with documented consent, and country-specific rules for home visits with recorded prior consent.
